After a person is stopped by a police officer on suspicion of driving while intoxicated, they will be asked to complete a field sobriety test. This test can range from a walk and turn test (in which the driver will be asked to take several steps forward in a straight line, turn around and follow the same path back) to the horizontal gaze nystagmus test (in which an officer will move a pen or their finger across a suspected drunk driver's eyes to see if the eyes have a slight spasm as they reach the corner). At the station, the driver will then be asked to take a chemical test, such as a urine or blood test. At this time, if the driver refuses, he or she may face serious consequences. Many police officers take this refusal as a sign of guilt of intoxication, and will push for maximum penalties, while there are many logical reasons that a person would refuse this time of test. Regardless, the state of Texas has an "implied consent" law, meaning that a person gives their consent to a breath or blood test at the time of receiving their driver's license.
